Picks On Clicks With An Rg Schtick: Building Long Term Sustainability In Esports Betting Growth, Brett Abarbanel

UNLV Gaming Research & Review Journal

During the COVID-19 pandemic, esports and its associated betting markets grew – and in some cases, continue to grow – exponentially as consumer entertainment filled the gap left by a sport shut down around the world. What does this mean for gambling-focused organizations seeking to enter the esports and gaming space? What lessons from gambling should gaming and esports organizations be aware of as they embark on the hunt for gambling-related partners? Through The Wire Act, John T. Holden 2020 Oklahoma State University - Main Campus

Through The Wire Act, John T. Holden

Washington Law Review

Legalized sports gambling has become one of the hottest topics in state legislatures ever since the United States Supreme Court’s 2018 decision in Murphy v. National Collegiate Athletic Ass’n1 allowed states to begin legalizing the activity. As states began to offer sports wagering, gambling became front and center in the news and the Trump administration’s Justice Department took the opportunity to rewrite a 2011 Office of Legal Counsel opinion, expanding the scope of the most prominent federal anti-gambling statute. The re-interpretation of the scope of the Wire Act reversed the Department of Justice’s position that the ...

How Pay-To-Win Makes Us Lose: Introducing Minors To Gambling Through Loot Boxes, Kourosh Azin 2020 Boston College Law School

How Pay-To-Win Makes Us Lose: Introducing Minors To Gambling Through Loot Boxes, Kourosh Azin

Boston College Law Review

Loot boxes are a feature in video games where players can acquire virtual goods like weapons, characters, or aesthetic alterations to enhance their gaming experience. Players can earn loot boxes through normal gameplay or purchase them with legal tender. The type and rarity of the rewards are commonly determined by a random number generator, ensuring that the success of acquiring a specific good is based on luck rather than skill. Due to the elements of consideration (wager), luck, and reward in loot box mechanisms mirroring those found in traditional gambling devices, some legislators view loot boxes as a form of ...

Taxation Of Electronic Gaming, Bryan T. Camp 2020 Texas Tech University School of Law

Taxation Of Electronic Gaming, Bryan T. Camp

Washington and Lee Law Review

At a doctrinal level, the subject of this Article is timely. During this time of the coronavirus pandemic, casinos have been closed and large populations have been subject to stay-home orders from local and state authorities. One can reasonably expect a large increase in electronic gaming and thus an increased need for proper consideration of its taxation. This Article argues for a cash-out rule of taxation.

At a deeper level, the subject of this Article is timeless. Tax law is wickedly complex for a reason. This Article explores that complexity using the example of electronic gaming. It grapples with the ...

The Safest Bet: A Comprehensive Review Of The Fall Of Paspa And The Rise Of Sports Betting, Daniel Boswell

University of Miami Business Law Review

In May of 2018, the United States Supreme Court held in Murphy v. National Collegiate Athletic Association that a federal prohibition on sports gambling was in violation of the anti-commandeering doctrine of the Tenth Amendment. In the wake of the decision, many commentators have opined that the opinion, authored by Justice Alito, may have serious implications on contentious political issues ranging from marijuana legalization to sanctuary cities. While the decision left state legislatures with the authority to permit sports gambling, it did not affirmatively close the door on federal oversight—a topic of much recent debate. This note will explore ...
